Welcome to MidLifeReset Kitchen.

These Terms of Service (“Terms”) govern your access to and use of the websites, landing pages, digital products, educational materials, recipes, audio content, video content, programs, memberships, downloads, communications, and other products or services made available by MidLifeReset Kitchen (“MidLifeReset Kitchen,” “we,” “us,” or “our”), collectively referred to as the “Services.”

Please read these Terms carefully before accessing or using the Services.

By accessing or using the Services, creating an account, or purchasing a product or service from us, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not access, purchase, or use the Services.

MidLifeReset Kitchen provides educational information, tools, digital products, programs, recipes, audio and video materials, and related content concerning subjects that may include:

  • food and meal preparation;
  • general nutrition education;
  • movement and physical activity;
  • mindset and behavior;
  • habits and routines;
  • lifestyle and general wellness; and
  • personal follow-through and self-care.

Individual products may contain different components, access periods, features, or usage requirements. The description presented on the applicable product page, sales page, checkout page, or order form is incorporated into these Terms with respect to that purchase.


3. Educational Purposes Only — No Medical Advice

MidLifeReset Kitchen provides general educational and informational content.

The Services are not medical care and are not intended to diagnose, treat, cure, prevent, or manage any disease, medical condition, mental-health condition, injury, or other health condition.

Nothing provided through the Services constitutes or should be interpreted as:

Some MidLifeReset Kitchen products may include general movement, stretching, mobility, strength, balance, aerobic, or other physical-activity suggestions.

Physical activity involves inherent risks and may not be appropriate for every individual.

Before beginning or materially changing an exercise or movement program, you are responsible for determining whether the activities are appropriate for you and for obtaining professional medical guidance when appropriate.

You should stop an activity and seek appropriate professional guidance if you experience concerning pain, dizziness, shortness of breath, faintness, injury, or other unusual symptoms.

To the fullest extent permitted by applicable law, you voluntarily assume the ordinary risks associated with participating in physical activities that you choose to undertake through or in connection with the Services.


5. Recipes, Ingredients, Allergies, and Food Safety

Recipes, meal ideas, ingredient suggestions, serving information, and nutritional information provided through MidLifeReset Kitchen are offered for general educational purposes.

You are responsible for:

  • reviewing ingredients before preparing or consuming food;
  • identifying ingredients that may cause an allergy, sensitivity, intolerance, medication interaction, or other adverse reaction;
  • determining whether recipes are suitable for your dietary needs;
  • making substitutions appropriate for your circumstances;
  • safely storing, handling, preparing, and cooking ingredients; and
  • following appropriate food-safety practices.

Ingredient brands, sizes, formulations, nutritional information, and availability may change.

If you have a food allergy, medical dietary restriction, metabolic condition, eating disorder, or other condition requiring individualized nutritional management, consult an appropriately qualified professional before relying on general recipe or nutrition content.


6. No Guarantee of Results

MidLifeReset Kitchen does not guarantee any particular physical, nutritional, weight-related, fitness, emotional, behavioral, lifestyle, or wellness outcome.

Results vary from person to person and may depend on numerous factors outside our control, including individual circumstances, consistency, starting point, health status, environment, behavior, and implementation.

Examples, customer stories, testimonials, demonstrations, or descriptions of individual experiences are not guarantees that you will achieve the same or similar results.

Nothing in these Terms permits MidLifeReset Kitchen to make a representation that would otherwise be unlawful or misleading under applicable law.


7. Accounts and Access Credentials

Certain Services may require you to establish an account or receive login credentials.

You agree to:

  • provide accurate and current account information;
  • maintain the confidentiality of your login credentials;
  • use reasonable measures to prevent unauthorized account access; and
  • promptly notify us if you believe your account has been compromised.

Unless an applicable offer expressly provides otherwise, an account and its associated product access are licensed to one individual user.

You may not:

  • share your login credentials with another person;
  • permit multiple unrelated individuals to use a single-user account;
  • sell, rent, transfer, sublicense, or assign your account;
  • purchase access primarily for unauthorized redistribution; or
  • circumvent technical restrictions intended to control access to the Services.

You are responsible for activity conducted through your account to the extent permitted by applicable law.


8. Digital Products and Personal-Use License

Unless expressly stated otherwise, purchases from MidLifeReset Kitchen provide you with a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and use the applicable digital materials for your own personal, non-commercial purposes.

Purchasing a digital product does not transfer ownership of the underlying copyrights, trademarks, recordings, designs, methods, written materials, videos, audio, worksheets, graphics, or other intellectual property.

Except as expressly permitted in writing by MidLifeReset Kitchen or by applicable law, you may not:

  • copy or reproduce our materials for distribution;
  • resell or sublicense them;
  • upload them to publicly accessible websites or file-sharing services;
  • distribute copies through groups, memberships, social-media communities, or shared drives;
  • modify them for resale or commercial distribution;
  • create competing or substantially derivative commercial products from them;
  • remove copyright, trademark, or proprietary notices;
  • systematically scrape or extract our content;
  • use our proprietary materials to train or develop a competing commercial artificial-intelligence, machine-learning, or content-generation system; or
  • otherwise commercially exploit the Services.

Limited printing or downloading for your own personal use is permitted where the applicable product makes such functionality available.

All rights not expressly granted are reserved.


9. Orders and Purchases

When you submit an order, you are offering to purchase the identified product or service under the terms shown at checkout and these Terms.

We may decline or cancel an order where reasonably necessary, including because of:

  • payment problems;
  • suspected fraud;
  • pricing or technical errors;
  • product unavailability;
  • legal or regulatory restrictions; or
  • suspected misuse of the Services.

If we cancel an order after payment has been successfully collected and no product or service is provided, we will issue an appropriate refund.

You agree to provide accurate and complete purchase and billing information and represent that you are authorized to use the payment method submitted.


10. Prices, Taxes, and Payment

Prices are displayed at the time of purchase and are subject to change for future purchases.

Unless expressly stated otherwise, a price change will not retroactively alter a completed one-time purchase.

You authorize us and our applicable payment processor to charge the payment method you provide for amounts that you affirmatively agree to pay.

Applicable sales, use, value-added, or similar taxes may be added where required.

Promotional pricing, coupons, discounts, bonuses, or special offers may be subject to additional terms shown with the applicable promotion.


11. Digital Delivery and Access

Most MidLifeReset Kitchen products are digital and may be delivered through:

  • email;
  • a customer portal;
  • a membership area;
  • download links;
  • streaming access;
  • an online course or content platform; or
  • another electronic delivery method.

You are responsible for providing an accurate email address and for maintaining compatible internet access, devices, and software needed to use the product.

Temporary interruptions resulting from maintenance, technology providers, internet disruptions, security events, or circumstances reasonably outside our control do not necessarily constitute failure to deliver a digital product.

The duration of access to a particular product is governed by the description or terms applicable to that product.


12. Refunds, Guarantees, and Cancellations

Because MidLifeReset Kitchen offers digital products that may provide immediate access to downloadable or consumable content, refund eligibility may differ by product.

Product-Specific Guarantees

If a sales page, checkout page, or order form expressly provides a refund period, money-back guarantee, satisfaction guarantee, or other refund right, that specific written offer governs that purchase.

You must comply with any reasonable eligibility requirements expressly disclosed as part of that guarantee.

When No Specific Guarantee Is Offered

If no refund or money-back guarantee is expressly stated for a digital product, the sale is final after digital access has been provided, except where a refund is required by applicable law.

13. Subscriptions, Memberships, and Automatic Renewal

This section applies only when the product or service you purchase is expressly identified at checkout as a subscription, membership, continuous service, or automatically renewing offer.

Before you enroll in an automatically renewing offer, the applicable sales or checkout page will identify the material recurring-payment terms, which may include:

  • the price;
  • billing frequency;
  • length of any initial term;
  • introductory or promotional pricing;
  • when recurring charges begin; and
  • how the subscription may be canceled.

By affirmatively enrolling in such an offer, you authorize the applicable recurring charges described at the time of enrollment until the subscription is canceled or otherwise terminates.

We will provide cancellation instructions and any renewal, reminder, trial-expiration, or price-change notices required by applicable law.

Cancellation generally prevents future renewal charges but does not retroactively refund charges already incurred, except where:

  • the applicable offer provides otherwise; or
  • applicable law requires a refund.

Specific subscription terms displayed during enrollment are incorporated into these Terms for that subscription.

If a subscription or membership offer conflicts with this general section, the more specific terms presented with that offer control.


14. Promotions and Bonuses

  • coupons;
  • promotional pricing;
  • bonuses;
  • bundles;
  • limited-time offers; or
  • other special promotions.

Additional terms disclosed with a promotion form part of the agreement governing that promotion.

Promotions may be modified or discontinued for future purchases, subject to applicable law.

Unless expressly stated otherwise, promotional benefits have no cash value and may not be combined with other offers.

The Services and their original content, including without limitation:

  • text;
  • recipes and original written presentation;
  • worksheets;
  • guides;
  • graphics;
  • photographs;
  • illustrations;
  • videos;
  • audio recordings;
  • downloadable materials;
  • product names;
  • logos;
  • branding;
  • website design; and
  • arrangement and presentation of content

are owned by or licensed to MidLifeReset Kitchen and are protected by applicable intellectual-property laws.

MidLifeReset Kitchen, associated product names, logos, designs, and branding may constitute trademarks, service marks, or other proprietary identifiers.

Nothing in these Terms transfers any ownership interest in our intellectual property to you.


16. User Communications, Feedback, and Reviews

If you voluntarily provide ideas, suggestions, or product-development feedback directly to MidLifeReset Kitchen, you permit us to use those suggestions for legitimate business and product-improvement purposes without an obligation to compensate you unless we agree otherwise in writing.

This provision is not intended to acquire ownership of an ordinary consumer review or prevent you from expressing an honest opinion about MidLifeReset Kitchen.

Nothing in these Terms prohibits or restricts you from posting an honest review or opinion about our products, services, or conduct.

If we wish to use your name, image, likeness, testimonial, transformation story, photograph, video, or other personally identifiable customer content in advertising or promotional materials, we may request additional permission where appropriate.

You may not knowingly submit content that:

  • infringes another person's intellectual-property rights;
  • violates another person's privacy or publicity rights;
  • is fraudulent or knowingly false;
  • contains malicious software; or
  • is otherwise unlawful.

17. Third-Party Services and Links

The Services may use or link to services provided by third parties, including technology platforms, payment processors, hosting providers, social-media services, analytics providers, or other external services.

Your use of a third-party website or service may be governed by that provider's own terms and privacy practices.

MidLifeReset Kitchen does not control and is not responsible for the independent content, availability, privacy practices, security, or conduct of unrelated third-party websites or services.

A link or technical integration does not necessarily constitute an endorsement of the third party.


18. Relationship With HighLevel

MidLifeReset Kitchen uses technology provided by HighLevel to help operate portions of the Services.

HighLevel provides technology infrastructure and is not the seller of MidLifeReset Kitchen products.

Purchases of MidLifeReset Kitchen products and services are transactions between you and MidLifeReset Kitchen unless a checkout page expressly identifies another seller.

HighLevel is not responsible for creating, delivering, guaranteeing, or providing customer support for MidLifeReset Kitchen products merely because its technology is used in connection with the Services.


19. Prohibited Uses

You may use the Services only for lawful purposes.

You may not use or attempt to use the Services to:

  • violate applicable law;
  • infringe intellectual-property rights;
  • gain unauthorized access to accounts, systems, or data;
  • distribute malware or harmful code;
  • interfere with website or platform security;
  • impersonate another person;
  • commit fraud;
  • harvest personal information without authorization;
  • scrape or systematically extract proprietary content for unauthorized commercial purposes;
  • circumvent access controls;
  • distribute purchased materials without authorization;
  • resell Services or account access without permission;
  • disrupt the normal operation of the Services; or
  • assist another person in carrying out prohibited activity.

We may suspend or terminate access where we reasonably believe these Terms have been materially violated.


20. Accuracy and Availability of Information

We make reasonable efforts to provide accurate and useful information, but errors, omissions, outdated information, broken links, technical problems, or typographical errors may occur.

We may correct errors and update information when appropriate.

Product descriptions, features, content, availability, and pricing may change for future purchases.

We do not guarantee that every part of the Services will be continuously available, uninterrupted, or error-free.


21. Modification or Discontinuation of Services

We may modify, update, replace, suspend, or discontinue portions of the Services when reasonably necessary for operational, security, legal, technological, or business reasons.

Where a material change affects a paid product for which you retain an existing contractual access right, we will address that change in accordance with the applicable purchase terms and law.

Nothing in this section authorizes us to disregard a specific written commitment made as part of your purchase.


22. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY EXPRESS WARRANTY OR GUARANTEE SPECIFICALLY PROVIDED WITH A PRODUCT, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, MIDLIFERESET KITCHEN DISCLAIMS WARRANTIES THAT ARE NOT EXPRESSLY SET FORTH IN THESE TERMS OR AN APPLICABLE PRODUCT OFFER, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE;
  • EVERY ERROR WILL BE CORRECTED;
  • A PARTICULAR PRODUCT WILL MEET EVERY USER'S INDIVIDUAL EXPECTATIONS; OR
  • USE OF THE SERVICES WILL PRODUCE A PARTICULAR RESULT.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. WHERE SUCH LAW APPLIES, THESE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED.


23. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIDLIFERESET KITCHEN AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SERVICES, INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.

TO THE FULLEST EXTENT PERMITTED BY LAW, MIDLIFERESET KITCHEN'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PAID PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO MIDLIFERESET KITCHEN FOR THAT PRODUCT OR SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, THE LIMITATIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.


24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless MidLifeReset Kitchen and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from:

  • your material violation of these Terms;
  • your unlawful use of the Services;
  • your infringement of another person's rights; or
  • content you knowingly submit in violation of applicable law.

This section does not require you to indemnify MidLifeReset Kitchen for its own unlawful conduct or for liabilities that applicable law does not permit us to shift to you.


25. Suspension and Termination

We may suspend or terminate your access to some or all of the Services where reasonably necessary because of:

  • material violation of these Terms;
  • fraud or suspected fraudulent activity;
  • unauthorized distribution of our intellectual property;
  • security threats;
  • misuse of an account;
  • nonpayment of amounts lawfully due; or
  • legal or regulatory requirements.

Where appropriate under the circumstances, we may provide notice or an opportunity to remedy the violation.

Termination does not affect rights or obligations that arose before termination.

Sections that by their nature should survive termination—including provisions concerning intellectual property, payment obligations, disclaimers, liability, and dispute provisions—will survive.


26. Privacy

Our collection and use of personal information are described in the MidLifeReset Kitchen Privacy Policy, which is incorporated into these Terms by reference.

The Privacy Policy should be reviewed separately because it contains important information regarding how personal information is collected, used, disclosed, retained, and protected.


27. Force Majeure

MidLifeReset Kitchen will not be responsible for delays or failures caused by events reasonably outside our control, including:

  • internet or hosting outages;
  • failures of third-party technology;
  • natural disasters;
  • fires;
  • severe weather;
  • epidemics or public-health emergencies;
  • acts of government;
  • labor disruptions;
  • utility failures;
  • cyberattacks; or
  • similar circumstances beyond our reasonable control.

This provision does not excuse obligations that applicable law does not permit us to exclude.


28. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to principles of conflicts of laws, except where another jurisdiction's mandatory consumer-protection law applies and cannot lawfully be waived.

Subject to any non-waivable rights you may have under applicable law, disputes arising from these Terms or the Services will be brought in an appropriate state or federal court located in Orange County, California, and the parties consent to the jurisdiction of those courts.

Nothing in these Terms prevents either party from pursuing a claim in an appropriate small-claims court where permitted.


29. Severability

If a provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed to the minimum extent necessary.

The remaining provisions will remain in effect.


30. Waiver

Our failure to exercise or enforce a provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

A waiver is effective only to the extent expressly provided.


31. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, reorganization, sale of business assets, corporate restructuring, or similar business transaction, subject to applicable law.


32. Changes to These Terms

We may update these Terms from time to time to reflect changes in our:

  • products or Services;
  • business practices;
  • technology;
  • service providers; or
  • legal or regulatory obligations.

When we update these Terms, we will revise the “Last Updated” date at the top of this page.

Material changes will be communicated where required by applicable law.

Changes generally apply prospectively and do not eliminate rights already vested under a completed purchase unless permitted by the applicable purchase terms and law.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.


33. Entire Agreement

These Terms, together with the Privacy Policy and any applicable product-specific terms, checkout terms, guarantee terms, subscription terms, or other policies expressly incorporated by reference, constitute the agreement between you and MidLifeReset Kitchen concerning the applicable Services.

If there is a conflict:

  1. product-specific purchase or subscription terms control with respect to that particular purchase;
  2. these Terms control with respect to general use of the Services; and
  3. the Privacy Policy controls concerning the collection, use, and disclosure of personal information.
